1. Introduction

These Terms of Service govern your access to and use of ImageFit AI, an AI image expansion and social media image resizing/adaptation tool available at https://expand.aiimagetools.cn. In these Terms, "ImageFit AI," "we," "us," and "our" refer to the operator of the Service.

By accessing or using the service, creating an account, uploading images, generating outputs, buying credits, or subscribing to a plan, you agree to these Terms. If you do not agree, do not use the service.

2. Service Description

ImageFit AI helps users upload an image and generate AI-expanded or resized results for social media formats such as RedNote, Instagram, Pinterest, TikTok, Reels, and Shorts.

The service may include account features, email verification, Google OAuth login, credit balances, one-time credit packs, monthly or yearly subscriptions, image generation history, candidate result previews, and download tools.

3. Eligibility and Accounts

• You must have legal capacity to use the service and comply with laws that apply to you.
• You may create an account using email/password or Google OAuth. You are responsible for keeping your account credentials secure.
• You agree to provide accurate account information and keep it up to date.
• Some features, including image generation, may require email verification, available credits, and an account in good standing.
• You are responsible for activity that occurs under your account, including uploads, generations, purchases, and use of credits.

4. User Content and Upload Rights

You retain any rights you have in images or other content you upload, subject to the license below and any rights held by others.

You represent that you have the rights, permissions, and authority needed to upload, process, transform, store, and use the images you submit through the service.

By uploading content, you grant us a limited, worldwide, non-exclusive license to host, store, process, transmit, transform, display, and generate outputs from that content only as needed to operate, secure, support, and improve the service.

• Do not upload content you do not own or do not have permission to use.
• Do not upload content that violates another person's copyright, trademark, publicity, privacy, or other rights.
• Do not upload sensitive personal information unless you are comfortable with the processing described in these Terms and our Privacy Policy.

5. AI-Generated Output

AI-generated or AI-expanded results may contain errors, distortions, artifacts, unexpected details, or content that is not suitable for your intended use. You are responsible for reviewing outputs before publishing or using them.

To the extent permitted by applicable law and third-party provider terms, we do not claim ownership of your generated outputs. You are responsible for ensuring that your use of outputs is lawful and does not infringe or violate third-party rights.

The service is a creative and productivity tool. It does not provide legal, professional, advertising, or brand clearance advice.

6. Credits, Plans, and Subscriptions

• Credits are service units used to generate images or access service features. Credits are not money, stored value, property, or a financial instrument.
• Credits are non-transferable and cannot be exchanged for cash, sold, assigned, or redeemed outside the service.
• Free registration credits, purchased credit packs, and subscription credits may be tracked separately for entitlement, expiration, refund, or anti-abuse purposes.
• Some credits may expire or be subject to limits as shown in the product, pricing page, or account rules.
• If generation fails after credits are deducted, the service may automatically refund credits for the failed generation according to the system's generation and refund logic.
• We may correct credit balances if there is an error, suspected abuse, refund, dispute, chargeback, or other entitlement issue.

7. Payments, Renewals, Cancellations, and Refunds

Payments, checkout, subscriptions, refunds, and disputes are processed by Creem or another payment provider we may use. We do not store full payment card details on our servers.

Monthly and yearly subscriptions renew automatically at the billing cycle and price shown at checkout or on the pricing page unless you cancel before the next renewal. Cancellation stops future renewals but may not automatically refund amounts already paid.

One-time credit packs are charged once and credits are added according to the product rules shown at purchase.

Refund eligibility and process are described in our Refund Policy. If a refund, dispute, chargeback, or payment reversal occurs, unused credits related to that payment may be removed and your account may be restricted.

8. Acceptable Use

You agree not to use the service to upload, generate, request, distribute, or promote content or activity that is illegal, harmful, abusive, or violates the rights of others.

• Illegal content or activity, including fraud, scams, impersonation, or malicious activity.
• Content that infringes intellectual property, privacy, publicity, or contractual rights.
• Pornographic, sexually exploitative, or non-consensual intimate content.
• Child sexual abuse material, child exploitation, or any sexualized content involving minors.
• Hate, harassment, threats, violent extremism, graphic violence, or targeted abuse.
• Content that reveals private information, invades privacy, or enables stalking or harassment.
• Malware, phishing, spam, automated abuse, credential attacks, scraping, or attempts to bypass rate limits, credits, payment, or security controls.
• Attempts to reverse engineer, overload, disrupt, or gain unauthorized access to the service or its providers.

9. Anti-Abuse and Account Restrictions

We use anti-abuse and security measures to protect the service, users, free credits, paid credits, and payment flows. These measures may use IP address, user agent, device identifiers, normalized email values, rate-limit records, account status, payment status, and usage history.

We may deny free credits, limit generation, suspend access, restrict an account, remove unused credits, or terminate access if we detect abuse, repeated bonus claims, payment disputes, refunds, chargebacks, unauthorized access, policy violations, or attempts to bypass limits.

Refunds, disputes, and chargebacks may cause unused credits connected to the payment to be removed and may restrict continued use of generation features.

10. Intellectual Property

ImageFit AI, the website, user interface, software, branding, documentation, and other service materials are owned by us or our licensors and are protected by intellectual property laws.

Except for your uploaded content and generated outputs as described above, these Terms do not grant you ownership in the service or its underlying technology.

If you provide feedback, suggestions, or ideas, we may use them without obligation to compensate you, unless otherwise required by law.

11. Third-Party Services

The service relies on third-party providers for authentication, email delivery, payments, object storage, AI image processing, database hosting, and application hosting. Examples include Google OAuth, Resend, Creem, Cloudflare R2 or similar object storage, third-party AI image generation/editing providers, Neon/Postgres, and Vercel.

Your use of third-party flows may be subject to the third party's terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

12. Privacy

Our Privacy Policy explains how we collect, use, share, and retain information, including account data, uploaded/generated images, payment and credit records, and anti-abuse data. Our Cookie Policy explains how cookies and similar technologies are used.

13. Disclaimers

The service is provided on an as-is and as-available basis. We do not guarantee that the service will be uninterrupted, error-free, secure, or that AI-generated outputs will meet your expectations or be suitable for any specific purpose.

We do not guarantee that generated images will be free of artifacts, rights issues, inaccuracies, or platform-specific publishing problems. You are responsible for reviewing and validating outputs before use.

14. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost business, or loss of goodwill arising from or related to the service.

To the maximum extent permitted by applicable law, our total liability for claims related to the service will not exceed the amount you paid to use the service in the three months before the event giving rise to the claim, or USD 100 if you have not paid us during that period.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold us harmless from claims, damages, losses, liabilities, costs, and expenses arising from your uploads, generated outputs, use of the service, violation of these Terms, violation of law, or infringement of third-party rights.

16. Termination

You may stop using the service at any time. We may suspend, restrict, or terminate your access if you violate these Terms, create risk for the service or other users, misuse credits or payment flows, or if we are required to do so for legal, security, or operational reasons.

After termination, provisions that by their nature should survive will continue to apply, including payment obligations, credit and refund rules, intellectual property, disclaimers, liability limitations, indemnification, and dispute-related provisions.

17. Changes to Terms

We may update these Terms when the product, providers, pricing, legal requirements, or business practices change. The latest version will be posted on this page with an updated effective date. If changes are material, we may provide additional notice where practical.

18. Governing Law and Disputes

These Terms will be interpreted and applied to the maximum extent permitted by applicable law. If a specific governing law is required, the laws of the jurisdiction where the operator of the Service is located will apply, except where mandatory consumer protection laws in your country or region provide otherwise.

If you are a consumer, nothing in these Terms limits any mandatory rights you may have under the laws of your place of residence.

Before filing a claim, you agree to first contact us at uplaysteam020301@gmail.com so that we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be handled by a court or authority with competent jurisdiction under applicable law.
